Due to the delayed votes over Castle Doctrine in the Pennsylvania House of Representatives & Senate, the NRA magazines that landed in today’s mailboxes are incorrect. One very important race deserves attention from voters, and we’ve got updates on other races around the Bucks County area vital for gun owners.

Rob Ciervo HAS been endorsed by the NRA Political Victory Fund, and his opponent decided to vote against gun owners & self-defense advocates on every single vote of his (hopefully) short legislative career. He is running to represent Newtown, Yardley, Lower Makefield & parts of Upper Makefield in State House District 31. Incumbent Rep. Santarsiero’s grade is now a D, and he has run to anti-gun groups seeking their support for his campaign. Gun owners in and around this area can support Rob Ciervo’s campaign by visiting his website.

Tommy Tomlinson running for re-election to Senate District 6 is now rated B+ and is NOT endorsed by the NRA Political Victory Fund. His recent vote to restrict the reciprocity agreements of concealed carry license holders was an unexpected vote against gun owners in Southeast Pennsylvania. If you’d like to contact Sen. Tomlinson and ask him why he voted against sportsmen in his district, his office number is (717) 787-5072 and his email address is rtomlinson@pasen.gov.

Here are all of the endorsed candidates on ballots in Bucks County & the rest of Pennsylvania’s 8th Congressional district:

Federal
US Senate – Pat Toomey
Congress – Mike Fitzpatrick

To the surprise of many gun owners, the battle to pass a simple self-defense law that allows you to defend yourself from attack on your own property was delayed for months by a small minority of the Pennsylvania House of Representatives. This comes as even more of a shock if you only look at the story through the vote totals from the final few votes on the issue. In this post, we’ll look at the story of how the final votes unfolded and how it may make an impact in elections around Bucks & Montgomery Counties.

With more than 130 co-sponsors, or 65% of the House members by the end of the House debate, it would appear that momentum was on our side when the bill was referred to the Judiciary Committee in January of 2009. No hearing was held until November of that year, with testimony from a variety of self-defense advocates, including Daniel Pehrson of the Pennsylvania Firearm Owners Association and John Hohenwarter of the NRA. Many more months passed before the bill was passed by the Judiciary Committee in May, after intense pressure from gun owners around Pennsylvania. It would be the first of two times the anti-rights leaders in the House would try to connect the bill with anti-gun legislation.

Unfortunately, the bill was then held up by the Appropriations Committee who does not support the Second Amendment, and, based upon his attitude and votes on Castle Doctrine, the right to self-defense. He refused all calls from gun owners and fellow lawmakers to release the bill for a vote until his hand was called by the bill’s primary sponsor with the threat of a discharge petition. Only when this petition was facing floor action did Rep. Dwight Evans agree to even allow a vote on the bill in his committee. He held true to his word the following day, September 29, 2010 – more than four months after his committee received it. With the release also came word that members of the House from the Philadelphia area planned to add between six to eight gun control amendments to the unrelated self-defense bill.

When the bill was allowed for second consideration on the House floor, Rep. Sam Smith pulled a procedural motion that limited debate and pointed out that none of the proposed amendments had anything to do with the nature of the bill – self-defense laws, not gun laws. The amendments were temporarily killed, and the legislation received the support of 156 members of the House. The following evening, the House took up the bill again – much to the chagrin of Philadelphia area lawmakers. They stood up to object, and the atmosphere was nearly riotous compared to the normally quiet tones in the chambers. One member shook his cane above his head as he made an impassioned plea to adjourn rather than allowing the pro-rights House members to vote for Castle Doctrine. Others raised their voices and objected to the idea of leaving the chambers simply to avoid a vote on an uncontroversial issue. In the end, the bill passed with even more support from the night before – 159 to 38.

While Rep. Todd Eachus accused the bill’s sponsors of being “heavyhanded” by using procedural moves to demand a swift vote, the better question might be whether the small number of opposing members truly used the heavy-hand by refusing to allow any votes on the bill at all.

Now the bill moves to the Senate, and some press accounts indicate that sources within the chamber plan to move the bill quickly for a vote in the remaining days of the session.

In the meantime, here are how representatives from parts of Bucks, Montgomery, and Philadelphia Counties voted on your right to self-defense:

Overall, NRA-endorsed candidates won more than they lost, and we seemingly may have picked up a couple of potentially positive seats here in Pennsylvania's 8th District.

Overall, NRA-endorsed candidates won more than they lost, and we seemingly may have picked up a couple of potentially positive seats.

First, of our endorsed incumbents, gun owners should congratulate State Reps. Paul Clymer and Gene DiGirolamo and Attorney General Tom Corbett. Tom Corbett’s re-election is particularly noteworthy to concealed carry license holders in the our district given the control over license reciprocity for the state’s gun owners. His opponent was F-rated and could have done significant damage to our progress on the issue. (Both opponents of the endorsed state representatives refused to return questionnaires.)

However, our non-incumbent endorsed candidates did not fare as well. Both happened to be Republican, and it was not a year where the stars were lined up for Republicans at the federal level. Tom Manion was defeated by anti-gun Patrick Murphy and John McCain was defeated by the most anti-gun presidential candidate in our history. We will spend the next two years informing gun owners of Patrick Murphy’s terrible record on our issue.

In at least one race with no endorsement, we seem to have improved our representation in Harrisburg for the residents of 142. Frank Farry, who forgot to return the questionnaire to NRA but sent a personal statement to NRA members that included a pledge to create a sportsmen’s council to advise him on our issues, defeated incumbent Chris King. King’s grade had dropped from an A- to a C- during his term. (Gun owners who may have contacted King over his short term in the PA House may recognize his treatment of constituents on display last night – he refused to attend his own watch party and thank his supporters or congratulate Frank Farry.)

The only other district to change hands was 31, and that was due to the retirement of an endorsed candidate. Unfortunately, for those residents, neither Pete Stainthorpe nor Steve Santarsiero returned questionnaires earning an endorsement. In fact, Stainthorpe did not return it at all. The eventual winner, Santarsiero, was given a B rating. Now it’s up to gun owners to let him know that they would like to see that grade go higher through his votes.

Our next election in 2010 will not only give us another opportunity to return the 8th District back into a pro-gun Congressional seat, but we will also be looking at a race for the Governor’s Mansion, as well as state Senate seats in the area, and all of the state House seats again. For the next two years, my focus will be on outreach and education. In speaking with many gun owners from Quakertown to Philadelphia, I found that many simply did not realize how lower ticket candidates had voted on their rights. Next time, we will educate even more gun owners for even higher turnout.

In the meantime, check back here for reports on how our local representatives are involved in all of the big gun news from the DC Beltway back to Harrisburg.
