We're counting down to the House vote on the issue of national concealed carry license reciprocity this afternoon, & some folks may wonder how Pennsylvania's lawmakers have been on the issue. We've got the rundown now.

We’re counting down to the House vote on the issue of national concealed carry license reciprocity this afternoon, and some folks may wonder how Pennsylvania’s lawmakers have been on the issue.

Back in April, we covered the bill shortly after it was introduced. At the time, we could proudly pat nine House members from the Commonwealth on the back for their support of the bill. Since then, more came on to co-sponsor, including Reps. Mike Fitzpatrick, Lou Barletta, and Tom Marino.

Based on a rule vote yesterday, it appears that the majority of the Pennsylvania lawmakers plan to support the bill.

These lawmakers deserve our thanks for their support in the vote:

Rep. Mike Kelly (R-3)
Rep. Jason Altmire (D-4)
Rep. Glenn Thompson (R-5)
Rep. Jim Gerlach (R-6)
Rep. Pat Meehan (R-7)
Rep. Mike Fitzpatrick (R-8)
Rep. Bill Shuster (R-9)
Rep. Tom Marino (R-10)
Rep. Lou Barletta (R-11)
Rep. Mark Critz (D-12)
Rep. Charlie Dent (D-15)
Rep. Joe Pitts (R-16)
Rep. Tim Holden (D-17)
Rep. Tim Murphy (R-18)
Rep. Todd Platts (R-19)

These are the lawmakers who voted against us on the rule:

Rep. Bob Brady (D-1)
Rep. Chaka Fattah (D-2)
Rep. Allyson Schwartz (D-13)
Rep. Mike Doyle (D-14)

We already told you about the pro-rights lawmakers from Pennsylvania supporting the McDonald challenge to Chicago's handgun ban. Now learn about who is working against your rights here at home.

Last month, 13 Representatives and both Senators from Pennsylvania stood up and told the Supreme Court that the Second Amendment is not only an individual right, but it is a fundamental right that must be applied to the state and local governments. They made clear that the right is not one that can be ignored by states or municipalities that may try to ban guns. But two members of the Pennsylvania delegation have decided to stand on the wrong side of history and oppose the right to bear arms.

Congressmen Bob Brady (D, PA-01) and Chakah Fattah (D, PA-02) joined a brief filed in favor of upholding a ban on handguns. In it, the Congressmen made the bizarre arguments that federal restrictions on fully automatic firearms dating from the 1930s clearly show that the Chicago handgun ban is constitutional. To further their “evidence,” they cite previous federal laws that merely acknowledge the existence of state firearms laws – such as those banning the use of firearms by violent felons – as reason to consider an outright ban to be legal. They seem to forget the Court made clear in Heller that bans are not merely legally debatable restrictions.

The following Pennsylvania Representatives also refused to stand up for Second Amendment rights, but they also avoided signing on to an outright attack on them:

Joe Sestak (D, PA-07)

Members of Congress are lining up to write a pro-rights brief in the history-making McDonald v. Chicago. Will the PA delegation join in? Here is the latest news.

On Friday, NRA-ILA announced that Senators Kay Bailey Hutchison (R-TX) and Jon Tester (D-MT) are joining forces with Congressmen Mark Souder (R-IN) and Mike Ross (D-AR) to write a bi-partisan joint amicus curiae brief in the landmark McDonald v. Chicago. Will Pennsylvania’s delegation join this pro-gun interpretation for the states?

In 2008, Sen. Hutchison lead an effort to organize a record number of members of Congress to sign a pro-individual rights brief in the Heller case. At the time, both Sen. Bob Casey and Arlen Specter signed onto the brief. In the House, 13 members of the Pennsylvania delegation signed the brief, including the 19th District’s Cong. Todd Platts. These members argued:

As Federal officials, we have a fundamental interest in protecting the constitutional rights of our constituents and the American people in general. …

The Second Amendment provides: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” Congress adopted that wording and proposed it to the States in 1789. It became part of the Bill of Rights which the States ratified in 1791. As the text and the drafting history demonstrate, the Amendment was intended to guarantee the right of individuals to possess and keep ordinary firearms.

What stands out are Pennsylvania’s members of Congress who refused to support such an interpretation and sought to deny an individual rights interpretation of the Second Amendment. Cong. Patrick Murphy (PA-8), Allyson Schwartz (PA-13), and Joe Sestak (PA-7) refused to sign on to the brief, ultimately ending up on the wrong side of history. Two other members of the delegation, Cong. Bob Brady and Chaka Fattah, actually lead the opposition by filing a brief making a claim that the Second Amendment is limited to militia service. Interestingly, not a single member of the Court agreed with this claim. Even the dissent brief acknowledged the individual right to own arms.

At this time, no members of the Pennsylvania delegation have indicated whether they will sign on to this brief or not. It would be reasonable to expect the same result with this brief, though we will keep you informed as names are announced.
