		<title>Dan Onorato&#8217;s Unconstitutional Mischief</title>

			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  class="size-full wp-image-11 alignright" title="flaggunconstitution" src="http://www.pagunrights.com/wp-content/uploads/2008/07/flaggunconstitution.jpg" alt="" width="295" height="190" />Gun owners in Pennsylvania might wonder if gubernatorial candidate Dan Onorato is wearing a leprechaun&#8217;s outfit today in celebration of the mischief he proposed late yesterday with his &#8220;plan for safe communities.&#8221;  His proposals include many <a href="http://www.pagunrights.com/category/candidates/governor/dan-onorato/">gun control policies we knew he supported</a>, but yesterday&#8217;s release marks a direct challenge to the Supreme Court&#8217;s <em>Heller</em> ruling in 2008, and the likely incorporation to the states that will come down in the <em>McDonald</em> case shortly.</p>
<p><a href="http://www.pagunrights.com/?attachment_id=981">Onorato&#8217;s campaign says</a>, &#8220;Onorato supports legislation requiring that homes with minors use effective child safety locks or other devices that keep children from being accidentally killed by firearms.&#8221;</p>
<p>No gun owner wants to see a child killed by any means.  For some families, locks are the best solution.  However, mandating locked guns in a private home blatantly flies in the face of a conclusion reached in <em>DC vs. Heller</em> two year ago.  Washington, DC required the few residents allowed to even own firearms to keep them locked away.  The justices were <a href="http://www.supremecourtus.gov/oral_arguments/argument_transcripts/07-290.pdf">very clear in their concerns</a> about infringement upon the right to self-defense with mandatory locks:</p>
<blockquote><p>JUSTICE SCALIA: I don&#8217;t understand that. What would that be &#8212; that you can, if you have time, when you hear somebody crawling in your &#8212; your bedroom window, you can run to your gun, unlock it, load it and then fire? Is that going to be the exception?<br />
GENERAL CLEMENT: If that&#8217;s going to be the exception, it would clearly be inadequate.<br />
&#8230;<br />
CHIEF JUSTICE ROBERTS: Well, before you start with it, how many minutes does it take to remove a trigger lock and load a gun? Because both the gun has to be unloaded; it has to have a trigger lock under the District law.<br />
MR. DELLINGER: Those are alternatives, Mr. Chief Justice.<br />
CHIEF JUSTICE ROBERTS: No, disassembly and trigger lock.<br />
MR. DELLINGER: I mean, this is simply an unlock.<br />
CHIEF JUSTICE ROBERTS: In either case it has to be unloaded, correct?<br />
MR. DELLINGER: There are some versions of the trigger lock that allow you to put the trigger lock on and then load the gun. But the piece that goes in the trigger mechanism, even someone as clumsy as I could remove it in a second.<br />
CHIEF JUSTICE ROBERTS: Well, the law, as I understand it, says that the gun has to be unloaded. So under your hypothetical, I assume that would violate the District&#8217;s law if the gun is still loaded.<br />
MR. DELLINGER: You &#8212; it&#8217;s a question of where you put the parenthesis. I read that as disassembled and unloaded or under a trigger lock, and that&#8217;s the &#8212; that&#8217;s the way the District reads it.<br />
CHIEF JUSTICE ROBERTS: So how long does it take? If your interpretation is correct, how long does it take to remove the trigger lock and make the gun operable?<br />
MR. DELLINGER: You &#8212; you place a trigger lock on and it has &#8212; the version I have, a few &#8212; you can buy them at 17th Street Hardware &#8212; has a code, like a three-digit code. You turn to the code and you pull it apart. That&#8217;s all it takes. Even &#8212; it took me three seconds.<br />
JUSTICE SCALIA: You turn on &#8212; you turn on the lamp next to your bed so you can &#8212; you can turn the knob at 3-22-95, and so somebody &#8211;<br />
MR. DELLINGER: Well &#8211;<br />
CHIEF JUSTICE ROBERTS: Is it like that? Is it a numerical code?<br />
MR. DELLINGER: Yes, you can have one with a numerical code.<br />
CHIEF JUSTICE ROBERTS: So then you turn on the lamp, you pick up your reading glasses &#8211;<br />
(Laughter.)<br />
MR. DELLINGER: Let me tell you. That&#8217;s right. Let me tell you why at the end of the day this doesn&#8217;t &#8212; this doesn&#8217;t matter, for two reasons. The lesson &#8211;<br />
CHIEF JUSTICE ROBERTS: It may not matter, but I&#8217;d like some idea about how long it takes.</p></blockquote>
<p>The case goes on focusing on DC&#8217;s specific laws.  However, the justices were quite clear that they were concerned about access and self-defense under a mandatory lock law.  <a href="http://www.law.cornell.edu/supct/html/07-290.ZO.html">Their decision</a> addresses the trigger lock law:</p>
<blockquote><p>As we have said, the law totally bans handgun possession in the home. It also requires that any lawful firearm in the home be disassembled or bound by a trigger lock at all times, rendering it inoperable.<br />
&#8230;<br />
We must also address the District’s requirement (as applied to respondent’s handgun) that firearms in the home be rendered and kept inoperable at all times. This makes it impossible for citizens to use them for the core lawful purpose of self-defense and is hence unconstitutional.<br />
&#8230;<br />
In sum, we hold that the District’s ban on handgun possession in the home violates the Second Amendment, as does its prohibition against rendering any lawful firearm in the home operable for the purpose of immediate self-defense.</p></blockquote>
<p>As many already realize, the District is a federal enclave, therefore <em>Heller</em> was limited in its scope.  However, the question before the Court in <em>McDonald</em> is whether the Second Amendment rights initially questioned in <em>Heller</em> are applied to states and municipalities.  With a favorable decision likely before the end of its term in June, Onorato is proposing a law that will violate the Court&#8217;s 2008 ruling on the scope of the Second Amendment and our right to self-defense in our homes.</p>
<p>The unconstitutional lock mandate isn&#8217;t the only gun control gun owners need to fear from Onorato.  He reiterates his support for a lost-and-stolen reporting law that would change the justice system into one in which gun owners are guilty until proven innocent. Prosecutors could financially ruin gun owners as they try to prove themselves innocent.</p>
<p>Finally, though he buries it in a separate paragraph, Onorato maintains support for his most controversial gun control plan – ending state preemption in Pennsylvania.</p>
<p>Under Onorato’s dismantling of state authority on gun laws, concealed carry permit holders could be arrested if they visit Philadelphia. Hunters heading to their favorite tree stand in the next county may find that their favorite hunting rifles are banned. Every time a gun owner crosses a city limit, he or she may be in violation of a local ordinance that could lead to arrest and cost them their rights.</p>
<p>There&#8217;s one thing that Onorato got right in this campaign when it comes to guns &#8211; any perception of him supporting the Second Amendment and the rights of gun owners or hunters is indeed <a href="http://twitter.com/PAGunRights/status/4657474425">&#8220;a mischaracterization.&#8221;</a></p>

			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  src="http://www.pagunrights.com/wp-content/uploads/2008/07/voteparty.jpg" alt="" title="voteparty" width="295" height="190" class="alignright size-full wp-image-64" />The easiest way to sort through the races for the 19 seats in Congress, 25 state senate seats, and 203 state house seats is similar to the way we sort for purposes of NRA-ILA EVC activity &#8211; by Congressional district and city.  If you don&#8217;t know your Congressional district, <a href="http://www.capwiz.com/nra/dbq/officials/">find it here first</a>.  You can then use the tool to find your state officials and details about your state house and senate districts.</p>
<p>First, a word about predictions and notes about how competitive seats are at this time.  In politics, a week can make or break a campaign.  We are more than nine weeks out from the May primary election and many, many weeks from the November election.  There is a strong air of anti-incumbent attitude this year, and actions in Washington may only strengthen it.  That will have an impact on down-ballot races. <p><strong><font color="b30300">PA-13 &#8211; Montgomery County with parts Philadelphia County</font></strong><br />
<em>incumbent</em></p>
<p><u><font color="1054a7"><strong>United State Congress</strong></font></u><br />
Democrats &#8211; <em>Allyson Schwartz</em><br />
Republicans &#8211; Dee Adcock, Brian Haughton, Josh Quinton</p>
<p>This seat is considered safe for Democrats according to many political analysts.  However, there has been a spirited race to challenge incumbent Congresswoman Allyson Schwartz.  A presumed frontrunner has already dropped out, and party leaders in the two counties in the district have endorsed two different candidates (Dee Adcock for Montgomery and Brian Haughton for Philadelphia).  While gun owners were no doubt like to get the F rated Schwartz out of office, it would be an uphill battle for either candidate.</p>
<p><u><font color="1054a7"><strong>Pennsylvania Senate</strong></font></u><br />
<strong>District 4</strong> &#8211; Abington, Jenkintown, Rockledge, Philadelphia<br />
Democrats &#8211; <em>Leanna Washington</em>, Lamont Thomas</p>
<p>This district, which is primarily in Philadelphia, does not appear to be competitive.  The F rated incumbent has held the office since 2005, and her challenger appears to have only run for lowers offices in Philadelphia with little success.  With no Republicans on the ticket, it is likely that Senator Washington&#8217;s name will be the only one on the ballot in November.</p>
<p><strong>District 12</strong> &#8211; Ambler, Bryn Athyn, Hatboro, Hatfield (Borough &#038; Township), Horsham, Lower Gwynedd, Lower Moreland, Montgomery, North Wales, Upper Dublin, Upper Gwynedd, Upper Moreland<br />
Republican &#8211; <em><a href="http://greenleafforsenate.com/">Stewart Greenleaf</a></em><br />
Democrat &#8211; Ruth Damsker</p>
<p>With a B rating, incumbent Senator Stewart Greenleaf is seeking another term for the seat he has held since 1979.  His opponent, though never having held an office for which she would earn a grade, has run on a ticket of gun control with current gubernatorial candidate <a href="http://www.pagunrights.com/2010/01/democratic-gov-candidates-address-gun-control/">Joe Hoeffel</a>.  Her joint answer to a questionnaire by a business group when she was running for office in 2007 called for a limit on firearm purchases which would stop collectors from buying matched sets and possibly even involve the creation of a gun owner registry.  Otherwise, her positions are short on details other than &#8220;state gun laws need tightening.&#8221;  While Ruth Damsker has won a county office in the area before, there doesn&#8217;t appear to be much commentary on the competitiveness of this race just yet.</p>
<p><strong>District 24</strong> &#8211; Green Lane, Landsdale, Lower Frederick, Lower Salford, New Hanover, Towamencin, Upper Frederick, Upper Salford<br />
Republican &#8211; <em><a href="http://www.electmensch.com/">Bob Mensch</a></em><br />
Democrat &#8211; Bill Wallace</p>
<p>The incumbent, Senator Bob Mensch, only <a href="http://www.pagunrights.com/2009/09/pa-senate-seat-stays-in-pro-gun-hands/">won this seat</a> a short time ago in a special election.  With his previous endorsement and A rating, Mensch will likely carry the support of gun owners again.  His opponent, an art teacher, has no history on the Second Amendment.  This seat has been in Republican hands for years, so it will likely be an uphill battle for Wallace.</p>
<p><strong>District 44</strong> &#8211; Schwenksville, Whitpain<br />
Republican &#8211; <em>John Rafferty</em></p>
<p>This A rated incumbent has no challengers on the ballot so far.  While it&#8217;s worthwhile to note that all candidates without competition now may face some in November if an opponent launches a successful write-in campaign for the other party, the time lost on the campaign trail will put them at a disadvantage.</p>

<p>This is a re-match from 2008.  With an A+ and endorsement, incumbent Rep. Bob Godshall is a great choice for gun owners considering his opponent refused to even answer questions for gun owners in the last cycle.  Given that the last election results were a blow-out with Rep. Godshall in a 20-point win, it is unlikely that the current election cycle will be any more favorable to Jack Hansen.</p>
<p><strong>District 61</strong> &#8211; Lower Gwynedd, Montgomery, North Wales, Plymouth, Upper Gwynedd, Towamencin, Whitpain<br />
Republican &#8211; <em>Kate Harper</em><br />
Democrat &#8211; Mary Lou Readinger</p>
<p>With a D- rating, the incumbent Rep. Kate Harper has maintained a pretty strong showing in her district, even during the last Democratic sweep.  As a local councilwoman, her opponent has no previous grade on the issue.  Based on past election results alone, it&#8217;s tough to see how this race will be competitive.</p>
<p><strong>District 70</strong> &#8211; Lower Salford, Towamencin<br />
Democrat &#8211; <em>Matt Bradford</em><br />
Republican &#8211; Jay Moyer</p>
<p>Again, a re-match from 2008, but one that may prove perilous for the incumbent, Rep. Matt Bradford.  In 2008, Bradford beat then freshman incumbent Jay Moyer by less than 900 votes.  Since then, the political winds have changed substantially and that may be enough to shift those votes back to Moyer.  With name recognition and a favorable political climate for the challenger, it&#8217;s tough to see how this won&#8217;t be a highly competitive race.  Gun owners should know that Rep. Bradford has refused to respond to NRA&#8217;s questionnaire while former Rep. Moyer maintained a B rating and was previously endorsed.</p>
<p><strong>District 146</strong> &#8211; New Hanover<br />
Republican &#8211; <em>Thomas Quigly</em><br />
Democrat &#8211; Mark Painter</p>
<p>As an A rated previously endorsed incumbent, Rep. Thomas Quigly should certainly have gun owners rallying around him in this race.  In his last election, Rep. Quigly maintained a comfortable lead.  His opponent is a local tax collector who has no history on our issue.</p>
<p><strong>District 147</strong> &#8211;  Green Lane, Lower Frederick, New Hanover, Schwenksville, Upper Frederick, Upper Salford<br />
Republican &#8211; Marcy Toepel<br />
Democrat &#8211; Robert Dodge</p>
<p>This open seat could be interesting to watch, depending on the quality of the campaigns given that they will actually be running in 2 different elections on the same day.  There is a special election on the same day as the primary to complete the term of previous Rep. Bob Mensch who held the seat comfortably in previous elections.  The Democratic nominee for the special election &#038; primary ballot has not held elected office before, abandoning a previous race after failing to even gather the minimum number of signatures required for ballot access.  The early hunch is that the race may not be terribly competitive, but given the nature of the special election creating a new incumbent before November, the dynamics will be fierce in these first two months.</p>
<p><strong>District 148</strong> &#8211; Plymouth, Upper Dublin, Whitemarsh, Whitpain<br />
Democrat &#8211; <em>Mike Gerber</em><br />
Republican &#8211; Matt Maguire</p>
<p>This is another re-match from 2008, though one that seems unlikely to flip since the incumbent won by 2-1 during the last race.  Even with political tides turning, that&#8217;s an awful lot of votes to switch in order to win the seat from an incumbent who has held the seat since 2005.  Gun owners may not have much at stake in this race since the incumbent is D rated and the opponent refused to return a questionnaire during the last cycle.</p>
<p><strong>District 151</strong> &#8211; Abington, Ambler, Horsham, Lower Gwynedd, Montgomery, Upper Dublin<br />
Democrat &#8211; <em>Rick Taylor</em><br />
Republican &#8211; Todd Stephens</p>
<p>This is a re-match between two candidates who duked in out in 2008.  Incumbent Rep. Rick Taylor has a D rating, and Todd Stephens never responded to NRA&#8217;s mailings.  With a difference of 419 votes in favor of the Democrat in 2008, this could be the year the GOP takes back the seat it held before Taylor&#8217;s election in 2006.  Based on the close vote margin in the last cycle that clearly favored his party, Rep. Taylor has reason to be nervous in this political environment.</p>
<p><strong>District 152</strong> &#8211; Bryn Athyn, Lower Moreland, Hatboro, Horsham, Philadelphia, Upper Dublin, Upper Moreland<br />
Republican &#8211; <em>Thomas Murt</em><br />
Democrat &#8211; Robert McGuckin</p>
<p>Incumbent Rep. Thomas Murt holds a D rating, and has served the residents of the area since 2007 when he defeated a member of his own party who had establishment support. Little has been found on his opponent, so it is unlikely we will have any information on the race for gun owners until closer to the election.</p>
<p><strong>District 153</strong> &#8211; Abington, Upper Dublin<br />
Democrat &#8211; <em>Josh Shapiro</em><br />
Republican &#8211; Tom Bogar</p>
<p>D rated incumbent Rep. Josh Shapiro is likely to keep his seat this time round, as he has won his last elections by solid margins &#8211; when he even had competition.  On the other hand, candidate Tom Bogar is embracing new media to build a grassroots audience, so perhaps there&#8217;s more in store for this race than meets the eye.  Since he&#8217;s a political newcomer, gun owners may have to wait to find out about Bogar&#8217;s policy views on our issues.</p>
<p><strong>District 154</strong> &#8211; Jenkintown, Philadelphia, Springfield<br />
Democrat &#8211; <em>Larry Curry</em><br />
Republican &#8211; Mary Beth Carroll, Tom Bell</p>
<p>While it would be nice to oust F rated incumbent Rep. Larry Curry from the seat he has held since 1993, this is a district that doesn&#8217;t even reliably draw Republican challengers and has seen them defeated by upwards of 50 points.  Regardless of the outcome of the GOP primary, this does not appear to be a competitive race.</p>
<p><strong>District 169</strong> &#8211; Philadelphia<br />
Republican &#8211; <em>Dennis O&#8217;Brien</em></p>
<p>This A rated incumbent has no challenger at this stage of the race, and it is unlikely that an opponent will emerge with enough backing to defeat the candidate who has held the seat since 1983.</p>
<p><strong>District 170</strong> &#8211; Philadelphia<br />
Democrat &#8211; <em>Brendan Boyle</em><br />
Republican &#8211; Marc Collazzo</p>
<p>Incumbent Brendan Boyle has only been in office for one term, but he won the seat by double digits.  He refused to answer the NRA questionnaire when he ran, so it is unclear what his position on the Second Amendment is at this time.  His opponent has not been in a position to answer a questionnaire.  While this seat was in GOP hands not long ago, it may be an uphill battle now.</p>
<p><strong>District 172</strong> &#8211; Philadelphia<br />
Republican &#8211; Joseph Gaynor, <em>John Perzel</em><br />
Democrat &#8211; Kevin Boyle, Daniel Collins, Tim Kearney, Karen Rotondo</p>
<p>This is going to be a fascinating race to watch.  It would normally be impossible to imagine an incumbent who has been in office since 1979 and served as Speaker of the House for three years to be in trouble.  Unfortunately for gun owners, our B rated and previously endorsed friend, incumbent Rep. John Perzel, may be facing an unexpectedly challenging race this year.  With charges pending related to using state resources for political work, it&#8217;s unclear how this may impact his re-election chances.  Rep. Perzel has denied any wrongdoing, and he won in 2008 by more than 38 points over his closest challenger, Tim Kearney, in a three-way race.</p>
<p><strong>District 173</strong> &#8211; Philadelphia<br />
Democrat &#8211; <em>Mike McGeehan</em></p>
<p>This D rated incumbent has been in office since 1991.  With no competition lined up this early, this election cycle should be a walk in the park for the Democratic lawmaker.</p>
<p><strong>District 174</strong> &#8211; Philadelphia<br />
Democrat &#8211; <em>John Sabatina</em></p>
<p>Though he has only been in office since 2006, D rated incumbent Rep. John Sabatina hasn&#8217;t attracted any competition for a while.</p>
<p><strong>District 175</strong> &#8211; Philadelphia<br />
Democrat &#8211; Pete Fiorentino, Daryl La Fountain, <em>Michael O&#8217;Brien</em><br />
Republican &#8211; Louis Schwartz</p>
<p>This D rated incumbent seems to have a solid lead for this long-time Democratic seat.  It is unlikely the primary or general election will be competitive.</p>
<p><strong>District 177</strong> &#8211; Philadelphia<br />
Republican &#8211; <em>John Taylor</em></p>
<p>After beating the last Democrat who opposed him by 2-1, it is unlike that the C rated incumbent will attract a top-level challenger this year.</p>
<p><strong>District 179</strong> &#8211; Philadelphia<br />
Democrat &#8211; <em>Tony Payton</em><br />
Republican &#8211; Matthew Franchetti</p>
<p>Perhaps it&#8217;s unsurprising that this longtime Democratic district is expected to stay in the hands of D rated incumbent, Rep. Tony Payton.</p>
<p><strong>District 202</strong> &#8211; Philadelphia<br />
Democrat &#8211; <em>Mark Cohen</em></p>
<p>This F rated incumbent is fully expected to hold the seat he has served in since 1974.</p>
<p><strong>District 203</strong> &#8211; Philadelphia<br />
Democrat &#8211; <em>Dwight Evans</em></p>
<p>This solid F rated incumbent faces no challengers for the seat he has held since 1981.</p>

If you don&#8217;t know your Congressional district, <a href="http://www.capwiz.com/nra/dbq/officials/">find it here first</a>.  You can then use the tool to find your state officials and details about your state house and senate districts.</p>
<p>First, a word about predictions and notes about how competitive seats are at this time.  In politics, a week can make or break a campaign.  We are more than nine weeks out from the May primary election and many, many weeks from the November election.  There is a strong air of anti-incumbent attitude this year, and actions in Washington may only strengthen it.  That will have an impact on down-ballot races. <p><strong><font color="b30300">PA-8 &#8211; Bucks County with parts of Montgomery and Philadelphia Counties</font></strong><br />

Democrats &#8211; <em>Patrick Murphy</em><br />
Republicans &#8211; Gloria Carlineo, Michael Fitzpatrick, Ira Hoffman, James Jones</p>
<p>The Republican race could be one to watch come May.  The local GOP did not endorse a candidate, though party leaders are clearly upset at the request from all candidates that they stand down in the primary.  Leaders have made sure to publicly announce their &#8220;unofficial&#8221; support for past Congressman Michael Fitzpatrick.  While Fitzpatrick may have the name recognition on the GOP ballot, Carlineo is already giving him a bit of a run for his money as a fellow recruit into the National Republican Congressional Campaign&#8217;s Young Guns program which recognizes candidates based on fundraising and outreach benchmarks.  Gun owners aren&#8217;t likely to learn much more in this race until a GOP candidate is chosen.  Fitzpatrick was initially endorsed and A rated based on his questionnaire in 2004, but some news reports indicate that after the endorsement, he called for a ban on semi-automatic rifles.  It is unclear if he has since changed his mind about supporting the gun ban or maintains a position similar to that of D+ rated incumbent Congressman Patrick Murphy who actually beat Fitzpatrick in 2006 for the same seat.  All-in-all, the race for the GOP nomination and for the seat in November will be fascinating for political junkies, though possibly less thrilling for gun owners.</p>
<p><u><font color="1054a7"><strong>Pennsylvania Senate</strong></font></u><br />
<strong>District 4</strong> &#8211; Abington, Philadelphia<br />
Democrats &#8211; <em>Leanna Washington</em>, Lamont Thomas</p>
<p>This district, which is primarily in Philadelphia, does not appear to be competitive.  The F rated incumbent has held the office since 2005, and her challenger appears to have only run for lowers offices in Philadelphia with little success.  With no Republicans on the ticket, it is likely that Senator Washington&#8217;s name will be the only one on the ballot in November.</p>
<p><strong>District 6</strong> &#8211; Bensalem, Bristol (Borough &#038; Township), Hulmeville, Ivyland, Langhorne, Langhorne Manor, Lower Southampton, Middletown, Northampton, Penndel, Warwick, Wrightstown<br />
Republican &#8211; <em>Tommy Tomlinson</em><br />
Democrats &#8211; Bryan Allen, John Jordan</p>
<p>Senator Tommy Tomlinson has held his seat since 1995 and maintained a A rating and endorsement.  There are two challengers from the Democratic side, but neither of which have a voting record on the issue or previous questionnaires.  Bryan Allen received the endorsement of the Bucks County Democrats, so he will have key support in the primary election.  Whether that turns into support at the polls remains to be seen, and whether either Democrat responds to the NRA questionnaire may also be up in the air given the lack of response by past candidates from the party in this race.</p>
<p><strong>District 10</strong> &#8211; Bedminster, Bridgeton, Buckingham, Chalfont, Doylestown (Borough &#038; Township), Dublin, Falls, Haycock, Hilltown, Lower Makefield, Morrisville, New Britain (Borough &#038; Township), New Hope, Newtown (Borough &#038; Township), Perkasie, Plumstead, Sellersville, Silverdale, Solebury, Telford, Tinicum, Tullytown, Upper Makefield, West Rockhill, Yardley<br />
Republican &#8211; <em><a href="http://www.mcilhinney.com/">Chuck McIlhinney</a></em><br />
Democrat &#8211; Cynthia Philo</p>
<p>As a one-term incumbent, Senator Chuck McIlhinney will still have to run a good campaign to hold his seat.  His competitor works primarily with downtown Philadelphia businesses, and has no record on the Second Amendment.  Senator McIlhinney had an A rating when he ran in 2006.  For now, there&#8217;s not much news out of this district.  Because there is no primary for either candidate, we may not know until the summer just whether or not there is major competition for the seat.</p>
<p><strong>District 12</strong> &#8211; Upper Dublin, Upper Moreland, Upper Southampton, Warminster, Warrington<br />
Republican &#8211; <em><a href="http://greenleafforsenate.com/">Stewart Greenleaf</a></em><br />
Democrat &#8211; Ruth Damsker</p>
<p>With a B rating, incumbent Senator Stewart Greenleaf is seeking another term for the seat he has held since 1979.  His opponent, though never having held an office for which she would earn a grade, has run on a ticket of gun control with current gubernatorial candidate <a href="http://www.pagunrights.com/2010/01/democratic-gov-candidates-address-gun-control/">Joe Hoeffel</a>.  Her joint answer to a questionnaire by a business group when she was running for office in 2007 called for a limit on firearm purchases which would stop collectors from buying matched sets and possibly even involve the creation of a gun owner registry.  Otherwise, her positions are short on details other than &#8220;state gun laws need tightening.&#8221;  While Ruth Damsker has won a county office in the area before, there doesn&#8217;t appear to be much commentary on the competitiveness of this race just yet.</p>
<p><strong>District 24</strong> &#8211; Durham, East Rockhill, Milford, Nockamixon, Quakertown, Richland, Richlandtown, Riegelsville, Springfield, Trumbauersville<br />
Republican &#8211; <em><a href="http://www.electmensch.com/">Bob Mensch</a></em><br />
Democrat &#8211; Bill Wallace</p>
<p>The incumbent, Senator Bob Mensch, only <a href="http://www.pagunrights.com/2009/09/pa-senate-seat-stays-in-pro-gun-hands/">won this seat</a> a short time ago in a special election.  With his previous endorsement and A rating, Mensch will likely carry the support of gun owners again.  His opponent, an art teacher, has no history on the Second Amendment.  This seat has been in Republican hands for years, so it will likely be an uphill battle for Wallace.</p>
<p><u><font color="1054a7"><strong>Pennsylvania House</strong></font></u><br />
<strong>District 18</strong> &#8211; Bensalem, Lower Southampton<br />
Republican &#8211; <em>Gene DiGirolamo</em></p>
<p>Incumbent Rep. Gene DiGirolamo doesn&#8217;t have any challengers on the ballot this year, which is great news for gun rights.  He has maintained an A rating and held the endorsement from NRA-PVF.</p>
<p><strong>District 29</strong> &#8211; Buckingham, New Hope, Solebury, Upper Southampton, Warminster, Warwick<br />
Republican &#8211; <em>Bernie O&#8217;Neill</em><br />
Democrat &#8211; Frank Feinberg</p>
<p>This race may not be terribly exciting for gun owners in the district, though that depends on the responses to the questionnaire by Frank Feinberg (or if he even answers the questions).  Incumbent Rep. Bernie O&#8217;Neill has been in office since 2003, and he maintains a C rating.  At this point, it&#8217;s unclear whether there&#8217;s a serious challenge here.</p>
<p><strong>District 31</strong> &#8211; Lower Makefield, Newtown (Borough &#038; Township), Upper Makefield, Yardley<br />
Democrat &#8211; <em>Steve Santarsiero</em><br />
Republican &#8211; Rob Ciervo</p>
<p>The incumbent Rep. Steve Santarsiero has only been in office for one term, so he&#8217;s hardly a shoe-in for the seat this time.  In the last race, Santarsiero had a B rating.  Opponent Rob Ciervo hasn&#8217;t held an office that requires a questionnaire at this point.  Ciervo has definitely had a very public campaign with letters to the editor in the local paper and catchy fundraisers.  This is a seat that formerly belong to the GOP, so it is possible for it to flip again.</p>
<p><strong>District 140</strong> &#8211; Bristol (Borough &#038; Township), Falls, Middletown, Morrisville, Tullytown<br />
Democrat &#8211; <em>John Galloway</em><br />
Republican &#8211; Jane Burger</p>
<p>Incumbent Rep. John Galloway holds a D rating, and he has held the office since 2007.  The seat has been in Democratic hands for decades, so it makes any race for the seat an uphill battle.  His opponent hasn&#8217;t held an office which would require a grade for the Second Amendment.  It isn&#8217;t likely that this will be a highly competitive race.</p>
<p><strong>District 141</strong> &#8211; Bristol Township, Middletown<br />
Republican &#8211; Rick Eccles, Kevin Glasson, Joseph Hogan<br />
Democrat &#8211; Tina Davis, Melvin Howard, Mike Slipp</p>
<p>This is an interesting race since the incumbent is retiring after more than twenty years in office.  The GOP has lined up behind candidate Rick Eccles while the Democrats have endorsed Tina Davis.  Neither has a record on gun rights, so we&#8217;ll have to wait for their responses to the NRA questionnaire before we know if gun owners have a good option in this race after years of an F rated incumbent.</p>
<p><strong>District 142</strong> &#8211; Hulmeville, Langhorne, Langhorne Manor, Lower Southampton, Middletown, Penndel<br />
Republican &#8211; <em>Frank Farry</em><br />
Democrat &#8211; John Toth</p>
<p>Rep. Frank Farry is a fresh incumbent, having only taken the office this term.  However, he did manage to win in a year that had overwhelming support for the opposite party.  Officially, he has no grade from NRA due to a mix-up with his campaign.  But in an effort to show his respect for our communities, he did send <a href="http://www.pagunrights.com/2008/11/second-amendment-statement-by-frank-farry/">a statement on his positions</a>.  His opponent has no record on the issue at this time, and it is unclear whether this will be a competitive seat.  It would appear unlikely at this time, but being a new state representative, Rep. Farry can be expected to run a serious campaign again.</p>
<p><strong>District 143</strong> &#8211; Bedminster, Bridgeton, Buckingham, Dolyestown (Borough &#038; Township), Durham, Nockamixon, Plumstead, Riegelsville, Tinicum<br />
Republican &#8211; <em>Marguerite Quinn</em><br />
Democrat &#8211; Kathy McQuarrie</p>
<p>Holding the office since 2007, Rep. Marguerite Quinn may face quite a challenge this year.  This C rated incumbent has an opponent who is a professional political activist &#8211; one who traveled the country for President Barack Obama since his early primary run.  If her political company is any measure of her own views, it is unlikely that Kathy McQuarrie will any improvement for the Second Amendment.  Until then, gun owners in the district will have to wait to see if she returns a questionnaire.</p>
<p><strong>District 144</strong> &#8211; Chalfont, Dublin, Hilltown, New Britain (Borough &#038; Township), Silverdale, Telford, Warminster, Warrington<br />

<p>With no challenger on the ballot at this stage, B rated incumbent Rep. Kathy Watson shouldn&#8217;t have any trouble.</p>

<p>When A rated incumbent Rep. Paul Clymer initially indicated he would retire at the end of the term, it apparently started a local uproar that convinced him to get back in the race.  His re-entry into the campaign sent some opponents scurrying since he has a history of dominating elections since he took office in 1981.  According to some online sources, Mary Whitesell realizes this race does not lean in her favor.</p>

<p>Incumbent Brendan Boyle has only been in office for one term, but he won the seat by double digits.  He refused to answer the NRA questionnaire when he ran, so it is unclear what his position on the Second Amendment is at this time.  His opponent has not been in a position to answer a questionnaire.  While this seat was in GOP hands not long ago, it may be an uphill battle now.</p>

Republican &#8211; <em>Scott Petri</em><br />
Democrat &#8211; David Apfelbaum or David Axelbaum</p>
<p>Incumbent Rep. Scott Petri maintains a B+ rating and has been in office since 2003.  There is confusion about his opponent since the Bucks County Democrats claim to have endorsed a Mr. Axelbaum while the list of candidates reported by the Pennsylvania Department of State indicates his name will be on the ballot as Mr. Apfelbaum.</p>

		<description><![CDATA[We've had some quiet success in the Philly suburbs against Michael Bloomberg &#038; his Pennsylvania gun control allies. We still need to work hard to oppose him. ]]></description>
			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  src="http://www.pagunrights.com/wp-content/uploads/2008/09/secondamendmentgun.jpg" alt="" title="secondamendmentgun" width="295" height="190" class="alignright size-full wp-image-106" />I think it’s quite ironic that it would seem that the gun rights movement is particularly strong in Southeastern Pennsylvania. CeaseFire Pennsylvania, in cooperation with Bloomberg’s Mayors Against Illegal Guns, have brought their <a href="http://www.lostandstolen.org/">preemption violating “Lost and Stolen” ordinances</a> to my neck of Pennsylvania.</p>
<p>This time we had some grassroots action ready to meet them. First in Radnor, <a href="http://www.nraila.org/Legislation/Read.aspx?ID=5455">which has tabled the bill until April</a>. On the same day CeaseFire Pennsylvania was tying us up in Radnor, Mayors Against Illegal Guns pushed the same ordinance to Hatboro. Hatboro <a href="http://montgomerynews.com/articles/2010/03/12/public_spirit_willow_grove_guide/news/doc4b9807e4711df809333309.txt">has rejected the ordinance route in favor of a resolution</a>, which they will be hearing Monday March 22nd. We still oppose the resolution, which urges the General Assembly to pass a state L&amp;S law, but we’ve made progress. <a href="http://www.timesherald.com/articles/2010/02/27/news/doc4b88b6d8d2e68104626781.txt">Ambler Borough has decided not to pursue an ordinance</a> a few weeks ago. Now word has it that Swarthmore, Pennsylvania, a bastion of liberalism even back when Delaware County was solidly Republican, <a href="http://www.delcotimes.com/articles/2010/03/12/news/doc4b99c87fa1f64978435843.txt">has decided to table its Lost and Stolen ordinance</a>.</p>
<p>This has to be huge embarrassment for Joe Grace, EVP of CeaseFire PA, and it’s a slap in the face to MAIG too. It’s no accident. It’s the work of gun owners getting involved, showing up, and making effective arguments to their elected representatives. We succeeded against a strategy that was designed to spread us thin and wear us out. It has, so far, failed to work. I know many readers were involved in these efforts, and we all owe them some thanks, especially to the people who were residents of these municipalities that showed up and spoke. Let’s hope we can keep pouring molasses over Bloomberg and Grace’s agenda. Let them have nothing without a fight.</p>

			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  src="http://www.pagunrights.com/wp-content/uploads/2008/07/voteparty.jpg" alt="" title="voteparty" width="295" height="190" class="alignright size-full wp-image-64" />With the final deadline for filing petitions to be on the ballot for the May primary having passed yesterday at 5pm, we saw only a few changes in who will run last night.  However, this morning, the scene is already changing.</p>
<p>In the race for governor, four Democrats and two Republicans made it on the ballot successfully.  On the Democratic side, <a href="http://www.pagunrights.com/2010/01/democratic-gov-candidates-address-gun-control/">we&#8217;ve covered their positions on gun control</a> before, except for <strong>Sen. Tony Williams</strong> who was not in the race at the time.  His last NRA rating was D &#8211; hardly a friend to the Second Amendment in Pennsylvania.</p>
<p>In the category of Lieutenant Governor, there was only one noteworthy surprise.  <strong>State Rep. Daryl Metcalfe</strong> filed rather unexpectedly for the office on the Republican side.  Both Democrats and Republicans have already endorsed in the race, and that support usually brings with it access to party support.  This morning, Rep. Metcalfe is expected to formally launch his bid for Lt. Gov. at the State Capitol today.  While Rep. Metcalfe has been a dedicated friend to gun owners, with the late start, a general lack of name recognition statewide to the broader electorate, and lack of a party endorsement, his campaign will likely be an uphill battle.  That might explain why he has also filed paperwork to run for his state house seat again at the same time.</p>
<p>In Congress, the competitive races fill up pages on the candidate list.  Consider that the race to oust <strong>Rep. Kathy Dahlkemper</strong> includes a two-way primary on the Democratic side and a six-way competition on the Republican side.  Over in the Southwest, the competition to take former Rep. John Murtha&#8217;s seat has a new set of twists and turns.  After <strong>Mark Critz</strong> won his party&#8217;s support for the special election to fill the rest of the term, former Treasurer <strong>Barbara Hafer</strong> announced she would still challenge him in the primary for the election in November.  However, after filing the paperwork last night to be on the ballot, she has already dropped out this morning.  Regardless, that still leaves a four-way race for the Democratic nomination and two-way competition for the GOP nomination in the 12th District.</p>
<p>In PA-8, <strong>Rep. Patrick Murphy</strong> has lined up four Republican challengers, two of whom have been recognized by the NRCC for meeting high campaign benchmarks.  In PA-13, the quest to unseat <strong>Rep. Allyson Schwartz</strong> has three GOP candidates on the ballot.  The two counties comprising the district split on their endorsements and a third candidate stayed in the race to take advantage of the split.  In PA-19, <strong>Rep. Todd Platts</strong> has challengers on both tickets, but he is expected to keep the seat.</p>
<p>Though some seats are considered extremely safe based on general popularity of the incumbent or makeup of the local electorate, it is noteworthy that only one Congressional seat has no challengers at all this year &#8211; that is PA-9 represented by <strong>Rep. Bill Shuster</strong>.</p>
<p>In the state house, there are few surprises.  We&#8217;ve covered the retirements fairly thoroughly.  And we&#8217;ll try to do a detailed breakdown for each area soon.  But, a quick check shows that some of our friends aren&#8217;t being challenged while others are.  The seats with the most names on the ballot are House districts 194, 195 and 199 and Senate district 22.  The first two each have seven Democrats and a single Republican while the latter House district has seven Republicans and one Democrat.  The Senate district also has seven Democrats with one lone Republican.</p>

			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  src="http://www.pagunrights.com/wp-content/uploads/2008/09/secondamendmentgun.jpg" alt="" title="secondamendmentgun" width="295" height="190" class="alignright size-full wp-image-106" />We&#8217;ve been fortunate with Pennsylvania&#8217;s Congressional delegation in that gun rights are typically respected by members of both parties (exceptions exist, obviously), so a tide of anti-incumbent attitude among the electorate could have a serious impact on the issues we care about.</p>
<p>Right now, eyes are focused on PA-12.  Deceased Congressman <strong>John Murtha</strong> was a dedicated advocate for the Second Amendment, and many of his possible replacements are unknowns.  Last weekend, local Democratic activists selected longtime aide <strong>Mark Critz</strong> to run for the special election to complete the term, and they will likely back him during the primary election to be held the same day.  However, the Democratic state committee is expected to meet today to issue the formal endorsement for the special election seat, and that may not be Critz.  Though he has local support, the state officials may opt for someone else to appear on the ballot with local support.</p>
<p>On the Republican side, local party leaders will meet on Thursday to select a candidate for the special election, and presumably give party support for the primary election.  Unlike the Democratic Party, the state leaders in the GOP cannot override the local decision.</p>
<p>Beyond the the southwest corner, there are other races heating up.  <a href="http://www.politicspa.com/politicspas-house-race-rankings/7386/">PoliticsPA has started a new feature</a> to examine the competitiveness of various Congressional races each month.  The race for PA-12 is considered only the fourth most competitive race.  Their predicted hotbed of activity? PA-7, the seat vacated by Congressman <strong>Joe Sestak</strong>.</p>
<p>For known incumbents, gun owners in PA-11 will have their hands full with the race featuring pro-gun Congressman <strong>Paul Kanjorski</strong>.  Early polling indicates he is very weak and may be defeated.  Up in the northwest corner, Congresswoman <strong>Kathy Dahlkemper</strong> will face a big challenge.  In a record year for Democrats in 2008, she just squeezed out a 7,000 vote victory over the incumbent representative.  This year may be the best chance to oust this F-rated freshman in PA-3.</p>
<p>At little closer to the Southeast, we have the 7th, 8th, and 9th most competitive races with PA-15 (pro-gun Congressman <strong>Charlie Dent</strong>), PA-8 (with leaning anti-gun Congressman <strong>Patrick Murphy</strong>), and PA-6 (with pro-gun Congressman <strong>Jim Gerlach</strong>).  These are vital races for Pennsylvania gun owners, and we need to turn out long before election day to make sure the right men and women take office.</p>

<p><em>Today, anti-hunting, animal “rights” forces met in Harrisburg to rally against organized bird shoots in the Keystone State. </em></p>
<p><em>Bird shooting is an historic and legitimate activity steeped in tradition with many participants throughout the Commonwealth and around the world.  For more than one hundred years, shoots have been held in Pennsylvania by law-abiding, ethical shooting enthusiasts, hunters, and sportsmen who would not tolerate an activity that would constitute cruelty to animals.</em></p>
<p><em>National animal “rights” extremist groups, led by the Humane Society of the United States (HSUS), have organized and funded efforts in Pennsylvania and around the country to ban this longstanding traditional shooting sport.  Make no mistake; this isn&#8217;t just about banning bird shooting, but banning all hunting species by species.</p>
<p>A few quotes from HSUS President, Wayne Pacelle, should help to explain their radical methodology and incremental approach of a complete hunting ban:</p>

		<description><![CDATA[Here's a reminder of Pennsylvania's connections to the upcoming Supreme Court case on gun bans and where to find live coverage. ]]></description>
			<content:encoded><![CDATA[<p><img class="alignright size-full wp-image-319" style="margin-left: 3px;  float: right; padding: 4px; margin: 0 0 2px 7px;" title="scotus" src="http://www.pagunrights.com/wp-content/uploads/2009/07/scotus.jpg" alt="" width="295" height="190" /> On Tuesday, the Supreme Court of the United States will here the landmark <em>McDonald v. Chicago</em> case that will ultimately answer the question about whether or not the Second Amendment is incorporated against state and local governments, and if so, how it is incorporated.  Because the hugely pro-gun <em>Heller</em> only dealt with the gun ban of a federal enclave, it did not address the issue of state and local gun laws such as Chicago&#8217;s ban on handguns.</p>
<p>Philadelphia spent resources <a href="http://www.pagunrights.com/2010/01/philadelphia-denies-second-amendment/">signing onto a brief</a> arguing that the Supreme Court should not force states and local governments to honor the Constitution, requesting that any rights to self-defense and arms be &#8220;minimized.&#8221;  Philadelphia&#8217;s two prominent Congressmen, <a href="http://www.pagunrights.com/2010/01/more-pennsylvania-voices-in-mcdonald/">Reps. Bob Brady and Chakah Fattah, are siding with the city</a> and Chicago in support of the handgun ban.</p>
<p>On the side of the Constitution, Pennsylvania&#8217;s <a href="http://www.pagunrights.com/2010/01/more-pennsylvania-voices-in-mcdonald/">Attorney General Tom Corbett and 15 state lawmakers have argued</a> that the Second Amendment is an important individual right and should be respected by state and local governments.</p>

Sadly, Pennsylvania actually ranks as the number 10 favorite state.  Though at least Keystone State gun owners can take some pride in the fact that the Brady Campaign considers our gun control laws to be less restrictive on our rights than those our neighbors to the north, south, and east.</p>
<p>Here are the laws the Brady Campaign likes in Pennsylvania:</p>
<ul>
<li>Restricted private sales of handguns</li>
<li>State registry of firearms sales</li>
<li>Mandate for gun locks with handguns</li>
<li>State universities are allowed to ban lawful possession by licensed, of age gun owners</li>
</ul>
<p>They don&#8217;t like that Philadelphia can&#8217;t ban guns due to statewide preemption.  They want to bring discretionary licensing like New Jersey to Pennsylvania.  They want to ban semi-automatic rifles and magazines of various sizes.  The Brady Campaign wants to ban all firearms use by children as old at 17 &#8211; no more Boy Scout merit badges for shooting or taking your grandchild on his or her first hunt.  They want to mandate a federal background check every time you purchase ammunition and require that records be kept to track who buys even a box of .22.  The group also wants to create a costly &#8220;ballistic fingerprinting&#8221; database &#8211; versions of which have shown absolutely no use in solving crimes in New York and Maryland.  Of course, they also plan to push for the usual bans on all private sales and import New Jersey&#8217;s permit to purchase system that often delays gun owners for 6 months or more to Pennsylvania.</p>
<p>To put our laws and grade in context, look to their grade of Massachusetts as a guide.  They rated Massachusetts as a 54 &#8211; an F.  The Bay State has discretionary firearms ownership licensing.  If a gun owner inadvertently ends up on a police chief&#8217;s bad side on the day he or she applies for a license to own a rifle or handgun, they could be rejected.  Massachusetts requires a gun license to even possess pepper spray.  If you take a new shooter to the range, they cannot collect relics of their day in the form of inert brass casings without a gun license.  In effect, there is no right to own a firearm in Massachusetts, and yet the Brady Campaign still considers it to be a failing state.</p>

		<description><![CDATA[There's a lot of chatter about change in the political sphere right now. Taking a look at some candidates, it's clear that there is much change for gun owners to worry about in the upcoming elections. ]]></description>
			<content:encoded><![CDATA[<p><img class="alignright size-full wp-image-11" style="margin-left: 3px; margin-right: 3px;;  float: right; padding: 4px; margin: 0 0 2px 7px;" title="flaggunconstitution" src="http://www.pagunrights.com/wp-content/uploads/2008/07/flaggunconstitution.jpg" alt="" width="295" height="190" /> Everybody is talking about change right now. Political retirements are making headlines across the country and across the state.  But as we close in on the deadlines to file for office, we now realize that not all change is good change for gun owners.  In fact, in the current streak of anti-incumbent attitude, we stand to lose ground if gun owners don&#8217;t get involved in campaigns quickly.</p>
<p><i><u>Federal Offices</u></i></p>
<p><strong>PA-15</strong><br />
Representative <strong>Charlie Dent</strong> has been an ally of gun owners for years, but he&#8217;s got a top-tier challenger backed by the Washington, DC Democrats and <a href="http://www.pagunrights.com/2008/10/obama-speaks-out-against-concealed-carry/">President Barack Obama</a>.  His challenger, John Callahan, is currently funded by NYC Mayor Michael Bloomberg in a coordinated effort to undermine preemption of gun laws in Pennsylvania and undo the key Supreme Court decision that ensures our laws are consistent throughout the state.  He works closely with <a href="http://www.snowflakesinhell.com/2009/09/25/links-between-brady-maig-established/">a lobbyist for the Brady Campaign</a> to promote more gun control at the local level.</p>
<p>If we don&#8217;t re-elect Rep. Dent, we&#8217;ll see an A rated seat flip to F overnight.</p>
<p><strong>PA-12</strong><br />
<a href="http://www.pagunrights.com/2010/02/the-future-of-pa-12-for-gun-owners/">An initial look</a> at early names dropped for the seat appeared very bright for gun owners, but question marks linger.  Since that early peek, more names have been mentioned as likely competitors and some have already removed themselves from the race.  Unfortunately, a good number of the names floated have no record on our Second Amendment rights.  Until candidates are finalized by party leaders, we may not know whether gun owners have a friend in the race.</p>
<p>This previously A rated seat may be headed into unknown territory unless gun owners call their respective political party leaders and let them know that any nominee for the special election to replace Rep. <strong>John Murtha</strong> should share his dedication to our rights.</p>
<p><i><u>State Offices</u></i></p>
<p><strong>Senate District 14</strong><br />
With the retirement of Senator <strong>Ray Musto</strong>, a previously A rated seat is now up for grabs.  There are two known Democratic candidates who are running for the seat, one who has a record in support of our rights and another who is working with anti-gun forces.  State Rep. <strong>John Yudichak</strong> is an A rated and previously endorsed lawmaker with an eye on the seat.  His primary challenger is Tom Leighton who, like one previously mentioned candidate, is also working with NYC Mayor Michael Bloomberg to undermine preemption of gun laws and undo a major Supreme Court decision on the matter.  Leighton also works closely with <a href="http://www.snowflakesinhell.com/2009/09/25/links-between-brady-maig-established/">the Brady Campaign lobbyist</a> in this effort.</p>
<p><strong>Senate District 22</strong><br />
The retirement of Senator <strong>Bob Mellow</strong> is particularly noteworthy for gun owners across the state.  As the highest ranking Democrat in the State Senate, his support for the Second Amendment made him a powerful ally within the Senate and his party.  With an A- rating, a flip of his seat to an anti-gun candidate would be tremendous loss.  Among candidate names floated so far, this seat could upgrade to an A or downgrade to an extremely anti-gun candidate.</p>
<p>State Rep. <strong>Jim Wansacz</strong> currently holds an A rating and has declared his candidacy for the seat.  However, since Chris Doherty has abandoned his gubernatorial run and in an effort to take the Senate seat, this will be a hot primary race for gun owners.  <a href="http://www.pagunrights.com/2010/01/democratic-gov-candidates-address-gun-control/">Doherty has called for an end to preemption</a> of gun laws in the state, meaning your concealed carry license may no longer be valid from town to town and various types of guns may be banned in different cities.  He also wants to limit the number of firearms gun owners may purchase, and presumably, create a registry to track such sales in accordance with the policy he is pushing.</p>
<p><strong>11 House Seats</strong><br />
Due to retirements, efforts to reach higher office, and early resignations, there are 11 seats open that have been previously rated A or higher.  Those who run for these seats are usually political newcomers or in offices that have little to do with Second Amendment and hunting issues.  As usual, NRA-ILA will send out questionnaires to the candidates to get them on the record.  However, the final list of candidates won&#8217;t be available until after petitions have been returned to appropriate election officials.</p>
<p><i><u>How to Help</u></i></p>
<p>There are three key ways to support pro-gun candidates right now.</p>
<ol>
<li>The easiest way is to donate money, especially if they have a primary battle for their party&#8217;s nomination.  Those elections are now three months out, so there is not much time to spare in order to raise money and get word out quickly.</li>
<li>The cheapest way to help a candidate is to volunteer your time.  Beginning today, candidates need to collect signatures in order to get on the ballot, and those deadlines are approaching.  Lending a few hours of your time is highly valuable to a campaign, and it costs you nothing.</li>
<li>The minimum effort gun owners need to put out right now is letting their friends and family members know who to support.  Make sure everyone is registered to vote, and make sure they know who you are voting for in the next election.  If you won&#8217;t open your wallet or donate your time, gun owners must absolutely open their mouths to promote candidates to everyone they know in the district.</li>
</ol>
<p>These races show that we&#8217;re at risk here in Pennsylvania.  If we end up filling pro-gun seats with anti-gun candidates, the next big attack on gun rights will happen right here in the Keystone State.  It&#8217;s up to us to make sure that these candidates who loathe our Second Amendment rights are sent to the curb, and these seats remain in pro-Second Amendment hands.  Don&#8217;t put your hunting and gun rights on the line this year.</p>

		<title>Fighting Local Gun Control</title>

		<description><![CDATA[Gun owners in Radnor recently organized to oppose local gun control efforts. Two EVCs attended in support of the group, and we wrote up some notes that you can use when you work locally. ]]></description>
			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  class="alignright size-full wp-image-71" title="secondamendmentgun" src="http://www.pagunrights.com/wp-content/uploads/2008/07/secondamendmentgun.jpg" alt="" width="295" height="190" />We&#8217;ve seen a wave of local gun control efforts across the Commonwealth.  Gun owners in various cities and townships have tried to work together to oppose these threats to our rights that are being pushed by the Brady Campaign, Michael Bloomberg, and New Jersey residents who tread over here.</p>
<p>Here are a few tips for organizing and delivering a message at city council meetings based on recent observations of local activists at work:</p>
<ul>
<li>Organize with other gun owners as much as possible before the event.  First, it increases likely turnout when gun owners know there will be others there to back them up and they are part of a team.  Second, you can divide the arguments.  Finally, there is power in numbers.  Whether you can recruit from your gun club, an email to friends and family, or on online forums (such as the state-specific <a href="http://forum.pafoa.org">Pennsylvania Firearm Owners Association</a>), try to convince folks to come out even if they sit silently in support of our rights.  Don&#8217;t forget about relevant non-residents who might have standing to speak &#8211; business owners, employees in town, and those who also visit and spend money in the area.</li>
<li>Dress accordingly. Not every speaker needs to dressed to the nines, but double check that your clothes are clean and appropriate. Remember that the underlying message you&#8217;re trying to send is that you&#8217;re an average resident and taxpayer who is concerned about the direction of city government getting into areas where they are not legally allowed to legislate. Just look neighborly.</li>
<li>For those willing to speak, divide your arguments by topic.  Assign one speaker to tackle each of your primary arguments to the fullest extent possible in only a few minutes.  This means each topic can be discussed at a deeper level in the limited time allotted for each speaker in many government meetings.  It also minimizes redundancy which could make leaders tune out remarks. Consider working to review each other&#8217;s prepared remarks to make sure each point is tackled.</li>
<li>If you do have help from out-of-towners, try to keep the core arguments limited to residents.  If the anti-gun leaders want to shut down debate, they will aim to limit it to residents only.  They may not realize how many gun owners actually live in town.</li>
<li>If you&#8217;re not used to speaking in public, write out your statement and print it in an easy-to-read format. It&#8217;s better to read well crafted remarks and stay on point than risk rambling on about other topics off the cuff. If you want to improve your presentation skills, practice at home in front of a video camera. Watching yourself speak on video is a harsh lesson, but it is the most honest assessment of both bad and good habits.</li>
<li>Don&#8217;t forget to identify yourself and how you are related to the community.  Sometimes it&#8217;s hard to remember to introduce yourself, but it is often required in town meetings and it serves to advance the argument that there are gun owners all around who want their rights respected.</li>
<li>If you have several arguments to make on a topic, number them in your remarks.  It will let councillors know that you have a well-developed argument that should be easier to follow.  If time begins to run out, it also gives them a polite way to ask you to quickly make the rest of your points.</li>
<li>Don&#8217;t fight with city leaders. If gun control is brought up at all, it is likely because there is at least one anti-gun leader on the board.  Understand that they are likely to try and defend their legislation.  At best, you may want to politely rebut any stinging arguments, but do not try to pick a fight with them.  Choose your battles wisely.</li>
<li>Don&#8217;t fight with the anti-gun leaders in the audience.  We know 99% of what they will say in advance.  There&#8217;s a very good chance that in your efforts to divide arguments, gun owners will have made the factual arguments that defeat their emotional pleas.  Unless a new argument is made, don&#8217;t worry about getting up to argue again and again.</li>
<li>Stick with the relevant facts.  As inspiring as it may feel to talk about the importance of the Second Amendment, most local leaders don&#8217;t really think about their responsibility to respect the federal Bill of Rights.  Unfortunately, until we end up with a favorable result in <em>McDonald</em>, the argument doesn&#8217;t hold much legal weight, either.  While a lofty reference or two for inspiration won&#8217;t derail your argument, keep the focus on immediate concerns they &#8211; and other residents &#8211; can identify with.</li>
<li>Look to other city issues that can supplement your arguments.  For example, with a major pothole problem, is it really in the city&#8217;s best interest to spend money on a gun control measure that&#8217;s likely to be struck down?  Remind them that as much as gun control might &#8220;feel good&#8221; to them, there are bigger local issues that must be dealt with at the moment.  Whether it comes in the form of potholes, schools, or taxes, most towns have more pressing needs on their agenda than gun control.</li>
</ul>
<p>Perhaps the most important tip in all of this is to stay in touch with those who turn out and help.  Connect online again &#8211; use <a href="http://facebook.com">Facebook</a>, <a href="http://forum.pafoa.org">PAFOA</a>, or even just have <a href="http://us.moo.com/en/products/minicards.php?gclid=CLW1taGh7Z8CFQ8E5QodOTeqfA">business cards with your email address</a> to share.  Maybe grab some coffee or hit the range with your new fellow activists.  Don&#8217;t forget that while we&#8217;re always trying to defend our rights, most of us were attracted to this issue because we truly enjoy the sports and the other people in the movement.</p>

Names were immediately thrown in the ring, but how have each of these candidates been on the Second Amendment? A friend like Rep. Murtha, or a foe?</p>
<p>Though some may wonder why the political game is starting in high gear so soon after his passing, it&#8217;s mainly due to unfortunate timelines in Pennsylvania&#8217;s election laws.  The governor must declare a date for a special election within 10 days that takes place at least 60 days out from the announcement.  Though he has not made an official statement, it is expected that Gov. Rendell will opt to schedule it on the same day as primary elections &#8211; May 18.</p>
<p>This sets up an interesting election for voters in Pennsylvania&#8217;s 12th Congressional District.  Party officials will have to decide on the candidates who run in the special election.  Due to the approaching deadlines for filing needed paperwork, it is expected that these decisions will be made quickly.  However, because the seat would have been up for grabs in November anyway, there still needs to be a primary election for the regularly scheduled November race.  In effect, voters will elect someone to fill the seat and vote for the same candidate in their respective primary races.  The candidates will have two campaigns to run this year.</p>
<p>Based on reports from political reporters, here are some of the names that have been dropped from each party and candidates who were previously planning a run at the seat:</p>

<blockquote>Party rules for Democrats and Republicans will determine how the special election candidate is selected. For Republicans, each county committee in the district will be assigned a certain number of conferees to send to the selection meeting. The conferees will vote to decide who becomes the party’s candidate.</p>
<p>For Democrats, the county committees in the 12th Districts will meet to recommend a candidate to the state party’s 50-member executive committee. The executive committee, comprising members from across Pennsylvania, will decide whether to endorse a candidate.</p></blockquote>

Perhaps that&#8217;s what the Democratic gubernatorial candidates were counting on when they debated at the Pennsylvania Progressive Summit.  Hoping gun owners, especially those registered as Democrats, wouldn&#8217;t find out, each of the candidates pledged to support more restrictions on your rights.</p>
<p>Allegheny County Executive <strong>Dan Onorato</strong> started the series of gun control promises by calling for a statewide so-called &#8220;lost and stolen&#8221; law.  He apparently doesn&#8217;t mind that the legislation would change the justice system into one in which gun owners are guilty until proven innocent.  Prosecutors could financially ruin gun owners as they try to prove themselves innocent.  Onorato continued by pledging to support &#8220;child safety locks,&#8221; though he declined to explain whether his version of the legislation would mandate the sale of locks to increase gun prices or challenge the ruling of <em>Heller</em> by forcing gun owners to lock their guns at home.  Finally, Onorato unveiled his most controversial plan for gun control &#8211; ending state preemption in Pennsylvania.</p>
<p>Under Onorato&#8217;s dismantling of state authority on gun laws, concealed carry permit holders could be arrested if they visit Philadelphia.  Hunters heading to their favorite tree stand in the next county may find that their favorite hunting rifles are banned.  Every time a gun owner crosses a city limit, he or she may be in violation of a local ordinance that could lead to arrest and cost them their rights.</p>
<p>Of course, Onorato <a href="http://twitter.com/PAGunRights/status/4657474425">told reporters at his campaign launch</a> that any perception of a pro-rights record was a &#8220;mischaracterization.&#8221;  I don&#8217;t think most gun owners would have realized how much of mischaracterization that really was!</p>
<p>Next, Auditor General <strong>Jack Wagner</strong> dodged most state policy issues on gun rights &#8211; save one.  Unfortunately for gun owners, it was a very, very big issue.  Wagner, while claiming to support the Second Amendment, stated his support for a ban on semi-automatic rifles.  These are not machine guns, but average rifles that gun owners often take into the field for hunting or to the range for competition.  He did not explain whether his support for such a ban would include confiscation for those already owned.</p>
<p>Third in line, Scranton Mayor <strong>Chris Doherty</strong> joined Onorato in his support of ending state preemption.  In fact, this was actually the priority pledge in his debate response.  Clearly, he hasn&#8217;t heard that <a href="http://www.pagunrights.com/2009/10/maig-lacks-public-support-for-agenda-in-pa/">a recent poll showed 56% of Pennsylvanians support preemption</a> of gun laws.  His other priority, should he take office, is to restrict sales of guns to only one per month.  Collectors would no longer be allowed to by matching sets.  The only way to track such sales would also mean the formal creation of a gun owner registry in Pennsylvania.</p>
<p>Finally, <strong>Joe Hoeffel</strong>, the candidate running farther left than most of the others kept his answer as essentially all of the above.  Specifically, he named these priorities: gun sales limits (and presumably the registry needed to track such sales), lost and stolen legislation, mandatory locks (though again without clarification on whether this applies to sales or storage), and the end of state preemption.  In addition to the previously discussed issues, Hoeffel also supports a ban on private sales of firearms in Pennsylvania.  Selling the rifle that collects dust in the back of the safe to a trusted family member will become a criminal act in Pennsylvania if Joe Hoeffel has his way.</p>
<p>Gun owners, particularly those who are registered as Democrats, need to speak out to these candidates.  The primary race is close, and there is no clear winner.  Make sure these candidates know that their support of gun control will cost them votes at the ballot box.</p>

<blockquote>&#8220;This summer, the Court will decide whether Chicago&#8217;s guns laws are constitutional. The case could affect or open the door to countless &#8212; and needless &#8212; legal challenges to local and state gun laws across the country. Today, we stand here on behalf of the people of Chicago and the United States who have been victims of gun violence, on behalf of their families and loved ones and on behalf of all those who believe Chicago&#8217;s current gun law is constitutional,&#8221; Daley said.</p>
<p>Daley added later, &#8220;America rose up about smoking&#8230;why can&#8217;t we have America rise up against gun violence?&#8221;</p></blockquote>
<p> The <em>Chicago Sun-Times</em> also reports that Mayor Nutter adamantly stated that &#8220;[t]he NRA is out of control.&#8221;  One can presume that he also means to argue the 4 million members, more than half a million of which are in Pennsylvania, are &#8220;out of control&#8221; for merely asking him to recognize their basic human right to defend one&#8217;s life and family.</p>
<p>The press conference served to promote <a href="http://www.pagunrights.com/2010/01/philadelphia-denies-second-amendment/">the brief previously filed by the mayors</a> asking the Supreme Court to &#8220;minimize&#8221; the right to self-defense.</p>

			<content:encoded><![CDATA[<p><img style=' float: right; padding: 4px; margin: 0 0 2px 7px;'  src="http://www.pagunrights.com/wp-content/uploads/2008/07/independencehall.jpg" alt="" title="independencehall" width="295" height="190" class="alignright size-full wp-image-12" />Democrats are concerned about the outcome of the Massachusetts special election that resulted in a come-from-behind win for State Senator Scott Brown.  As pundits are now saying, no seat is safe.  Republicans are feeling emboldened by the win.  Pundits wisely point out that incumbent Republicans should still be cautious since the political mood is best described as anti-incumbent as opposed to being in favor of any one party.</p>
<p>But what does a special Senate election in Massachusetts have to do with local politics in Pennsylvania?  Quite a lot, actually.</p>
<p>The anticipated struggle of incumbents and mood that independents may continue to break right-of-center this year means that retirements will likely kick into high gear over the next month or two.  Already, we have witnessed the announcements of a handful of NRA A or A+ rated incumbents who will not seek re-election in the fall.</p>

<p>Some may be retiring hoping that their seat is more likely to stay in the hands of their current party.  Others may anticipate challenges during either a primary or general election.  Regardless, the retirement announcements are not likely to let up anytime soon.  At least three anti-gun incumbents also plan to leave office in 2010.</p>
<p>The Pennsylvania election calendar gives incumbents some time to delay their announcements into the new year.  Nominating petitions (to run on a party primary ballot) are not due until early March.  If more incumbents get nervous, expect to see more retirement announcements through the next few weeks.</p>
